Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Metronova service ("Service") operated by OurHertz (우리들의주파수, "Company"). By creating an account you agree to these Terms.
2. Definitions
- Service: The Metronova web application providing BPM analysis, metronome track generation, and audio management.
- User: Any person who creates an account and uses the Service.
- Points: Virtual currency units used to access Service features.
- Content: Audio files, BPM analysis results, or other data generated or uploaded by a User.
3. Eligibility
- You must be at least 14 years old to use the Service.
- You must provide accurate information during registration.
- One account per person; accounts may not be transferred or shared.
4. Points System
Points are virtual currency used to access Service features such as YouTube audio extraction and export.
- Points are purchased via card payment through our payment processor (PortOne / KG INICIS).
- Points have no cash value and cannot be transferred to another account.
- Points expire 1 year after your last point purchase, unless otherwise notified.
- Remaining points are forfeited upon account deletion.
5. Payments and Refunds
All card payments are processed through the PortOne payment platform via KG INICIS payment gateway. Prices are displayed in Korean Won (KRW).
Refund Policy
Because purchased Points are immediately available for use as digital content, refunds are generally not provided pursuant to Article 17(2)(5) of Korea's Act on Consumer Protection in Electronic Commerce. However, you may withdraw your purchase (request a refund) within
7 days of the original payment date if
all of the following conditions are met:
- None of the purchased Points have been used.
- Your current Points balance equals the full amount credited from the purchase.
Refunds are processed only through the same payment method used for the original purchase.
To request a refund, email
[email protected] with your registered email address, payment date, and amount.
If points are not delivered due to a payment error or system failure, the Company will promptly issue a refund or credit the points.
6. Acceptable Use
You agree not to:
- Use another person's identity or provide false information
- Attempt to hack, reverse-engineer, or disrupt the Service
- Upload audio that infringes third-party copyrights
- Manipulate or tamper with the payment system
- Distribute or share data containing audio (e.g., exported files) in any public venue or to third parties for any purpose other than personal backup. Any legal liability arising from such distribution rests solely with the person who distributed the content; the Company bears no responsibility.
- Use the Service for any unlawful purpose
7. Intellectual Property
Copyright in audio files you upload remains with the original rights holders. Metronome tracks and analysis results generated by the Service are owned by you, the User. The Company's software, brand, and original content remain the property of OurHertz.
Data containing audio (including exported files) may only be used for personal backup purposes. Distributing or sharing such data in public or with third parties may constitute copyright infringement. All legal responsibility for such acts rests solely with the distributor.
8. Service Availability
- We aim to provide the Service 24/7 but do not guarantee uninterrupted availability.
- Scheduled maintenance will be announced in advance.
- If we discontinue the Service, we will provide 30 days' notice.
9. Disclaimer of Warranties
The Service is provided "as is." We do not warrant the accuracy of BPM analysis results; they are provided for reference only. We are not liable for losses caused by force majeure (natural disasters, cyberattacks, etc.) or by your own actions.
10. Account Termination
You may delete your account at any time via the Settings page. Upon deletion, your personal data and remaining Points are immediately removed. Payment history is retained as required by law.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Korea. Disputes that cannot be resolved amicably shall be submitted to the court having jurisdiction over the Company's registered address.
